Procedural Principles in Arbitration

When serving as an arbitrator, Prof. Dietmar Czernich conducts proceedings according to the following principles

Disclosure
Disclosure of any potential conflict of Interest according to the IBA Guidelines on Conflict of Interest in International Arbitration 2014

Shortlisting the chairman
Before appointing the chair, parties will be given a say on the chair by submission of a shortlist for strikes/ranks

Hearing
No procedural decision of the arbitrator without previously having heard the parties

Equality
Absolutely equal treatment oft he parties

Evidence
Taking of evidence according to the IBA Guidelines on Taking of Evidence in International Arbitration, unless parties agree otherwise

Witness Conferencing
Efficient taking of personal evidence also by employing special techniques („Hot tubbing“).

Time-Frame
Rendering award within 6-8 weeks after post-hearing briefs
